SeeYouOnShabbos.com is a Website dedicated to bringing together prospective Shabbos hosts, who wish to share the beauty and joy of their Shabbos experience, and individuals (prospective guests) looking to partake in a Shabbos experience. To accommodate both prospective hosts and prospective guests, we’ve created two databases (two registration processes), one for each, and the rules that apply to each differ. Please take note to understand the rules that apply to each prior to completing the registration process. For your convenience, we have separated the rules that apply to you as a Guest from those that apply to you as a Host in the Terms of Use below. All other rules outlined in the Terms of Use will apply to all users equally. Please note that the two designations (Host & Guest) are not mutually exclusive. That is, you may choose to be a host on a particular Shabbos and also wish to experience Shabbos as a guest at the homes of other families on another. We encourage our users to experience Shabbos both as guests and hosts, as each presents differing opportunities and perspectives on the Shabbos experience.  

We are excited by the endless possibilities and opportunities presented by this website, and we hope all your experiences in connection with this Website will be positive and uplifting. In order to ensure our users’ positive experiences, we’ve created a set of rules by which users must abide. Together, these rules and conditions form a legal contract between you, other users, and us. As a contract, the language is cold and clinical at times. Please do not be offended by that. Our mission is to bring joy and beauty to Shabbos experiences around the world, and we’re here to help make that happen.

 In the Terms of Use (the contract), the term “you” and “user” refers to all users of this Website, including Hosts and Guests. The purpose of these rules is to create a comfortable, respectable, and safe atmosphere where Hosts and Guests can connect. Additionally, it is important for us to make clear, and for you to fully understand, that we cannot, nor do we, take any responsibility for any actions of other users or third parties. As such, when you offer or accept an invitation, any risks associated with the same is entirely yours. Please be sure to read the Warranties and Disclaimers in our Terms of Use for more information prior to offering or accepting an invitation, and of course, please take all precautions to keep yourself safe.

1.      ACCEPTANCE OF TERMS

SeeYouOnShabbos makes this website, SeeYouOnShabbos.com (the “Site”), including all information, documents, communications, files, text, graphics, photographs, software, products and services available through the site (collectively, the “Materials”) and all services offered by SeeYouOnShabbos.com and third parties, including individuals registered as Shabbos Hosts on the Site, through the site (collectively, the “Services”), available for your use subject to the terms and conditions set forth in this document and any changes to this document that SeeYouOnShabbos.com may publish from time to time (collectively, the “Terms of Use”).

By accessing or using this Site in any way, including, without limitation, registering as a Guest or Host, use of any of the Services, downloading of any Materials, or merely browsing the Site, you agree to and are bound by the Terms of Use.

SeeYouOnShabbos.com reserves the right to change the Terms of Use and other guidelines or rules posted on the Site from time to time at its sole discretion. Your continued use of the Site, or any Materials or Services accessible through it, after such notice has been posted constitutes your acceptance of the changes. Your use of the Site will be subject to the most current version of the Terms of Use, rules and guidelines posted on the Site at the time of such use. You should periodically check these Terms of Use to view the then current terms. If you breach any of the Terms of Use, your authorization to use this Site automatically terminates.

2.      DEFINED TERMS

The term “Host” means an individual registered on the Site as a Host, and the term “Guest” means an individual registered on the Site as a Guest. All user-supplied information, materials, files, communications, guest-book entries, comments, and photographs are referred to collectively as “User Content.” “SeeYouOnShabbos.com Content” means all Materials provided by SeeYouOnShabbos. User Content and SeeYouOnShabbos.com Content may have different restrictions and conditions associated with them.

The terms and conditions expressed in this agreement apply to all users and visitors of this Site.        

3.      USER AGE

By creating a User account on the Site you are representing that you are at 18. If you are under the under the age of 18 years you are NOT permitted to use this Site.

4.      GUEST PROFILES, RULES; REGISTRATION

A.          Quick Guest Profiles. We offer you the ability to create a quick cursory guest profile. In order to create this profile you will be required to provide the following information: your email address, first and last name, gender, year of birth, phone number, synagogue affiliation if any, and a reference. As a user with a Quick Guest profile you will have the ability to search for prospective hosts, but your profile will be invisible to others on the Site unless you decide to initiate contact with another Site user.

B.           Standard Guest Profile. In order to create a standard profile, in addition to the information you would need to provide to create a Quick Guest profile, you will also need to provide the following information: your city, state, zip code, 2 references, dietary needs, and one picture. The Standard Guest profile allows you to include some optional information such as your occupation and general information about yourself. SeeYouOnShabbos.com shall be the final arbitrator as to whether a particular uploaded photograph is appropriate given the nature of the Site, and SeeYouOnShabbos.com shall have the right to delete any photographs it deems, in its sole discretion, to be inappropriate. Please note that, upon registration, the default setting allows for other Users, namely prospective Hosts, to view your profile and offer the Guest a Shabbos invitation. This setting may be changed once you are logged in to your account.

         With a Standard Guest profile you will have the ability to submit direct requests to prospective hosts. Once a host accepts a request and confirms a reservation, contact information will be shared between the Host and Guest.  

5.      HOST RULES; REGISTRATION

To register as a SeeYouOnShabbos.com Host, complete and submit the registration form. You will be required to include all the information required to create a Standard Guest profile (See Section 4(B)). AGE: You must be at least 18 years or older to create a profile without the express verified consent of your guardian. To complete a Host profile you must upload at least one picture. The Host profile allows you to include some optional information about your family. Please use your discretion when uploading information about your family as we are unable to screen the Site users or to vouch for their integrity.  

6.      SHABBATON PRIVILEGES

If you are interested in arranging a Shabbaton please contact us and inquire about the Shabbaton Privileges. Upon approval, you will have the ability to use the Site on a broader scale to facilitate the proposed Shabbaton. For example, with Shabbaton Privileges you will be able to communicate with a group of prospective hosts, to post messages, create guest lists, and create Shabbaton itineraries.

7.      INTELLECTUAL PROPERTY; LIMITED LICENSE TO USERS

The Materials and Services on this Site, as well as their selection and arrangement, are protected by copyright, trademark, patent, and/or other intellectual property laws, and any unauthorized use of the Materials or Services at this Site may violate such laws and these Terms of Use. Except as expressly provided herein, SeeYouOnShabbos.com does not grant any express or implied rights to use the Materials and Services. You agree not to copy, republish, frame, download, transmit, modify, distribute, license, reverse engineer, or create derivative works based on the Site, its Materials, or its Services or their selection and arrangement, except as expressly authorized herein. In addition, you agree not to use any data mining, robots, or similar data gathering and extraction methods in connection with the Site.

In addition to the Materials and Services offered by SeeYouOnShabbos.com, this Site may also make available materials, information, and services provided by third parties (collectively, the “Third Party Services”). The Third Party Services may be governed by separate license agreements that accompany such services. SeeYouOnShabbos.com offers no guarantees and assumes no responsibility or liability of any type with respect to the Third Party Services. You agree that you will not hold SeeYouOnShabbos.com responsible or liable with respect to the Third Party Services or seek to do so.

Except as expressly indicated to the contrary elsewhere on this Site, you may view, download, and print the SeeYouOnShabbos.com Content and User Content available on this Site subject to the following conditions:

1        The SeeYouOnShabbos.com Content and User Content may be used solely for personal, informational, and internal purposes.

9.      LICENSE TO SeeYouOnShabbos.com FOR USER CONTENT

Certain Services offered through this Site, such as the guest-book, for example, accommodate or require User Content. Depending upon the nature of the Service, by submitting User Content to this Site you grant SeeYouOnShabbos.com the following type of license: For User Content that is the result of your creative efforts and which is intended to be displayed on the Site, you grant SeeYouOnShabbos.com a worldwide, royalty-free, non-exclusive license to modify (for purposes of formatting, maintenance, or Site administration only) and reproduce such User Content. You also grant SeeYouOnShabbos.com the right to distribute and publicly display and perform such User Content for the purpose for which such User Content was submitted to the Site. SeeYouOnShabbos.com reserves the right, in its sole discretion, to delete or remove User Content from the Site and to restrict, suspend, or terminate your access to all or part of this Site, at any time without prior notice or liability. SeeYouOnShabbos.com may, but is not obligated to, monitor or review any areas on the Site where users transmit or post User Content, including but not limited to areas where Services are available, and the substance of any User Content. Likewise, SeeYouOnShabbos.com is under no obligation to post any User Content you submit, and SeeYouOnShabbos.com may, at its sole discretion, choose to not post your User Content. To the maximum extent permitted by law, SeeYouOnShabbos.com will have no liability related to User Content. SeeYouOnShabbos.com disclaims all liability with respect to the misuse, loss, modification, or unavailability of any User Content.

13.  WARRANTIES AND DISCLAIMERS

You understand and acknowledge that SeeYouOnShabbos.com does not screen its users and cannot vouch for the character or trustworthiness of any user on this Site, and SeeYouOnShabbos.com cannot possibly control the actions of its users. As such,   SeeYouOnShabbos.com makes no representations or warranties whatsoever about any Hosts or Guests accessed or introduced through the Site, their character or trustworthiness. Any and all dealings and interactions, whether in person or otherwise, are at your own risk. You agree that SeeYouOnShabbos.com will not be liable for any harm that is caused to you by other Site Users.  

The use of the Services or the downloading or other use of any Materials through the Site is done at your own discretion and risk and with your agreement that you will be solely responsible for any damage to your computer system, loss of data, or other harm that results from such activities. SeeYouOnShabbos.com assumes no liability for any computer virus or other similar software code that is downloaded to your computer from the Site or in connection with any Services or Materials offered through the Site. No advice or information, whether oral or written, obtained by you from SeeYouOnShabbos.com or through or from the Site shall create any warranty not expressly stated in these Terms of Use.

14.  PERSONAL INFORMATION AND PRIVACY

15.  LIMITATION OF LIABILITY

In no event, including, without limitation, negligence, shall SeeYouOnShabbos.com, its subsidiaries, affiliates, agents, officers, directors, employees, or partners be liable to you or any third party for any special, punitive, incidental, indirect, or consequential damages of any kind, or any damages whatsoever, including, without limitation, those resulting from injury or death, loss of use, data, or profits, whether or not SeeYouOnShabbos.com has been advised of the possibility of such damages or injury, and on any theory of liability, including torts, arising out of or in connection with the use of or the inability to use this Site, its Services, or Materials, the statements or actions of any Site User on or through the Site, any in-person dealings or interactions with any Site User or any individuals connected to such Site Users, any unauthorized access to or alteration of your transmissions or data, any information that is sent or received or not sent or received, any failure to store or loss of data, files, or other content, any Services available through the Site that are delayed or interrupted, or any website referenced or linked to or from this Site.

16.  INDEMNITY AND LIABILITY

You agree to indemnify and hold SeeYouOnShabbos.com, and its subsidiaries, affiliates, officers, directors, agents, partners and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party or User due to or arising out of content you submit, post to, or transmit through the Site, your use of the Site, your connection to the Site, your physical actions against another, your violation of these Terms of Use or your violation of any rights of another person or entity.

17.  GOVERNING LAW AND JURISDICTION

This Site (excluding linked sites) is controlled by SeeYouOnShabbos.com from its offices within the state of New Jersey, United States of America. By accessing this Site, you and SeeYouOnShabbos.com agree that all matters relating to your access to, or use of, this Site shall be governed by the statutes and laws of the State of New Jersey, without regard to the conflicts of laws principles thereof. You and SeeYouOnShabbos.com also agree and hereby submit to the exclusive personal jurisdiction and venue of the Courts within the State of New Jersey with respect to such matters.

18.  GENERAL

The Terms of Use and the other rules, guidelines, licenses and disclaimers posted on the Site constitute the entire agreement between SeeYouOnShabbos.com and you with respect to your use of the Site. If for any reason a court of competent jurisdiction finds any provision of these Terms of Use, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the parties as reflected by that provision, and the remainder of the Terms of Use shall continue in full force and effect. Any failure by SeeYouOnShabbos.com to enforce or exercise any provision of these Terms of Use or related right shall not constitute a waiver of that right or provision
